In this assignment I will compare the rights and responsibilities of both employer and employee looking at their similarities and differences and explaining them. I will point out each similarity and difference by sections – RIGHTS and RESPONSIBILITIES. Also I will stop my attention at explaining how important is to be able to compare both sides and what are the consequences for both parts if we were not able to compare them and there weren’t any similarities and differences..


* Both sides (employer and employee) have the right to talk to each other about everything and nothing when it comes to work, help or something connected with safety and health * Both, employer and employee have the rights to contribute a good agreement in the contract obligating each one depending on their needs and wants. However the employee should still keep close to the companies rights which have been set up by the employer. * Employer and Employees can be discriminated within direct or indirect discrimination. Both sides are allowed to ask for help. * Both sides are allowed to ask for procedures protecting their relationships between employees and employers. * Both sides are responsible as representative bodies for the views and rights of an organization or a group. However here plays the decision of the boss. * Both sides can make changes in contracts if they both are agreed with it.

This means that if the employer wants to make change, he should talk with his worker and if the other part agrees then the change may be proceed.| * Employers have the rights to set up the business aims. This means that the employees cannot choose how to work or in what way the company should operate because this job is for the employer. * Employers are able to take the decisions while the employees, just do the tasks set by their bosses. This simply shows that the employees are under the control of their employer. * Only the employer can take disciplinary actions and to make forbiddance for his employees if its needed while the employees have to relate to the laws set by their boss. * Only the employer can choose how many hours a worker can work relating to the EWTD. This means that relating to EWTD the boss can choose how many hours his worker should work. This can be up to 48 hours / week. * The employee cannot choose how to do the tasks because each company has instructions which the employee should stay in touch with.


* Both employer and employee have to follow the legal laws and should accept codes of practice relating to the business. This means that both sides must obey the current laws. They cannot do whatever they like, because each one should act as in their position. * Both sides must not break the contracts signed by them. This means that the employer cannot just change something in the contract and make the worker to do something else which is not listed in the contract. This also refers to the employee, they cannot do whatever they like which is not in the contract. * The both sides must obey the laws and keep the property safe and in good condition. They both are responsible for the property and they should not damage it or destroy it, because if that happens the company may have to cover all the fixing costs. * The business cannot afford existing uphold business aims and objectives if the workers don’t fit with it.

* Only the employer needs to be in charge of keeping the company’s workers out of danger. This doesn’t mean that the employees mustn’t be careful with their working process, but this means that the employee must make sure that the company’s workers are out of danger and they feel comfortable and safe. * The employer can refer to ACAS for guidance. This simply says that the boss can ask for help from third part organizations for solving their problems. * The employees are the ones who should follow the laws and cooperate with their employer in a more strict way because the employer has set up working laws. This doesn’t mean that the boss shouldn’t follow the laws, but it shows that the employees are the ones under a kind of control to which they should relate.

Outlining differences and similarities is really important because in this way we can see what each role has to do and also it shows us how they differ in different ways. For example this shows us what the employer can do while the employee cannot but he just does the task set by the boss. The similarities show us what the both sides have in common and what exactly makes them closer to each other. The differences show us what is different between them and what one side can do while the other cannot and also they show us how each side is dependable on the other side because everything is connected. If there were not similarities and differences between the employers and the employees there would be a total anarchy because everything would be the same and everyone would do whatever they like. The consequences are these that without being able to compare if there are not similarities and differences, the companies would not operate properly because everything in this worlds has got different way of living, working, doing things and etc. and there won’t be people having higher authority over people with less authority.
